Among other things this would stay an adoption proceeding if a paternity suit is brought; grant paternity to a putative father seeking paternity rights if the mother does not object; establish a “best interest of the child” standard for not granting custody in these cases; establish a child support formula; and more.

Senate Bill 1201 (Revise details of putative father procedures ) Introduced by Sen. Ray Basham (D) on March 3, 2010, to establish that if a putative father files a petition seeking to have his paternity established in law and the mother does not respond, a court must declare the man to be the father (issue an “order of filiation”). If the father then petitions for custody and the mother does not seek to have the order of filiation set aside, the court must grant custody, unless it determines this presents a reasonable likelihood of harm to the child.
