Michigan Equally Shared Parenting Bill 4778 Action Alert

Those of you who live in Michigan please go to this bill(HB4778)and then contact each one of the sponsors of this bill. If you know someone in Michigan please ask them to contact these sponsors. Let the sponsors know that we appreciate their support but now is the time to get movement on the bill. The sponsors need to present the bill via a legislative forum in the House and or the Senate Office Buildings. Also they need to pressure their Judiciary Committee colleagues to have a hearing or move the legislation to another committee or to the floor for a vote.

Oregon Will Fine for False Reports of Child Abuse

In an effort to keep people from maliciously filing false reports of child abuse in the midst of divorce, custody fight, or other domestic conflict, the Oregon Legislature passed legislation making it a Class A violation resulting in a $750 fine.

One of our members, Gordon Hillesland, has tracked this legislation through the Oregon House and Senate. Ten years ago, his wife accused him of abusing his children when she was seeking a divorce. The accusations, even though he was never charged, ruined his life.

Perhaps this statute would have prevented his wife from filing the claim:

419B.016 Offense of false report of child abuse.
(1) A person commits the offense of making a false report of child abuse if, with the intent to influence a custody, parenting time, visitation or child support decision, the person:
(a) Makes a false report of child abuse to the Department of Human Services or a law enforcement agency, knowing that the report is false; or
(b) With the intent that a public or private official make a report of child abuse to the Department of Human Services or a law enforcement agency, makes a false report of child abuse to the public or private official, knowing that the report is false.
(2) Making a false report of child abuse is a Class A violation. [2011 c.606 §2]

Now is the time for the Massachusetts Legislature to appoint a Shared Parenting Task Force. On the heels of the resounding success of the Massachusetts Alimony Task Force, Fathers and Families wants the same for our children with a Shared Parenting Task Force.

Call your legislator today!

I am asking every Massachusetts Fathers and Families reader to advocate for the Shared Parenting Task Force that our legislative leaders promised. Please call your legislator and tell them or a member of their staff:

Now it is time to produce the single most important reform for the welfare of our children — shared parenting — in the family courts. The legislature used a task force to work out the solution for alimony, please use this same powerful tool for shared parenting for our children. Ask the Judiciary Committee's Chairs to appoint a Shared Parenting Task Force: Senator Cynthia Stone Creem and Representative Eugene L. O'Flaherty.

Shared parenting is best for children in families with two parents living together and for children where the parents are living apart through no fault of the children. Anything less than the presumption of shared parenting in the family courts not only penalizes innocent children, but it causes many of the problems our children suffer in today's society.

Shared parenting is simply a collaborative arrangement in which both parents share custody of their children. It is the best solution for most separated, divorced, and never-married families. It provides children ample time with both parents and, just as important, with both extended families. Through a ballot initiative, over 86% of Massachusetts voters have already stated that they want shared parenting.

Identify yourself as a member of Fathers and Families. Let them know that Fathers and Families' mission is to improve the lives of children and strengthen society by protecting the child's right to the love and care of both parents after separation or divorce.

Find your legislator or call 617.722.2000 to reach their office.

Some of your Massachusetts Senators and Representatives have already stated their commitment to shared parenting. They have signed on as sponsors to Fathers and Families bill HB2684 sponsored by Representative John W. Scibak. Or they have signed on as sponsors to other shared parenting legislation: HB1306 sponsored by Representative Colleen M. Garry; SB847 sponsored by Senator Richard J. Ross; or SB659 sponsored by Senator Stephen M. Brewer.
If any of the legislators listed below are your representative or senator, thank them for protecting our children and ask them to take the next step and seek the appointment of a Shared Parenting Task Force.
