LITTLE ROCK  The Arkansas Court of Appeals on Wednesday upheld the state Department of Human Services decision to terminate the parental rights of an Arkansas man who was serving in the Army in Iraq when his wife’s boyfriend severely injured his 5-month-old son.

OK Legislator Blasts Family Law System; F & F's Gregory Tells Committee 'We Need Shared Parenting'

An adult child of divorce, Rep. Jason Nelson criticized the courts for marginalizing his father.

Fathers and Families member Chris Gregory, a Marine combat veteran of Desert Storm and Somalia, recently told an Oklahoma House of Representatives committee that the family law system is rife with injustices and often separates children from the fathers they love and need.

Led by Representative Mark McCullough and Representative Jason Nelson, the Oklahoma House of Representatives conducted an interim study on family law and no fault divorce earlier this month. According to the legislators' press release here, "Oklahoma's family law is dangerously failing the children it is supposed to protect, leading some lawmakers to consider reform of both divorce statutes and the foster-care system."

Representative Nelson (R-Oklahoma City), a child of divorce, said:

[O]ur current divorce system is a racket that enriches attorneys and makes children and communities poorer. Divorce scars children and leaves them emotionally disfigured. The current divorce laws are perverse and they are destroying children and our society.

Representative Nelson spoke movingly about his childhood and watching the pain on his father's face at not being allowed to spend much time with his son, as well as the financial privations the system put upon him. Nelson concluded with a call for a presumption of shared parenting after divorce.

The Chris Gregory Case–an Outrageous but Common Injustice

Former Marine Chris Gregory, recipient of the Combat Action Ribbon, told the Committee, 'We need shared parenting.'

F & F's Chris Gregory, the father of three girls who adore their dad, had a standard child custody order forced upon him—an order which granted his ex-wife "exclusive care, custody, and control of the parties' minor children," and allows Gregory's girls only a few days a month with their father.

For the past three years, Gregory has fought in court to get more time with his girls, ages 11, 9, and 6. He has racked up large legal bills, as he was forced to pay for his ex-wife's attorney—an attorney whose focus has been to minimize Gregory's role in his children's lives. He explains:

The court has denied all of my motions to modify custody or seek an equitable outcome.

Financial Plunder

Chris Gregory's Paycheck

Gregory, who was asked by Representative McCullough to share his experiences with the divorce system, is a good example of the way fathers are plundered financially.

The financial orders in Gregory's case are more or less garden variety in a divorce, yet while Gregory earns $7,500 a month after taxes, by court orders he is to be left with merely $1,750 a month to live on. That's correct–family court leaves Gregory less with less than a quarter of his post-tax income. The breakdown is as follows:

Gregory's monthly earnings after taxes: $7,518
Gregory's child support: $2,568
Gregory's alimony: $1,000
Gregory's garnishment to pay his ex-wife's attorneys' fees: $1,726
Total left to Gregory post-family court and taxes: $1,758

According to the family court, Gregory, a successful Senior Consultant at a major software company who earns a $125K a year salary, should be left with a mere $21,096 a year to support himself and his three girls.

The child support and the attorneys' fees are garnisheed directly from Gregory's check. The $1,000 a month alimony is not, Gregory has not been paying it lately, and faces a contempt charge for it. As in many divorce cases, the attorneys' fees Gregory owes grew out of his fight to be allowed to play a meaningful role in his children's lives.

Here are a couple of items of interest.

Modern rock band Blue October releases their new album, 'Any Man in America' today.  The album chronicles band founder and lead singer, Justin Furstenfeld's, divorce and ensuing child custody battle.  Blue October is teaming up with ACFC to promote Shared Parenting and family law reform on their 40 city tour which begins tomorrow in Dallas, Texas at the House of Blues.  Check out the Blue October website and collaboration press release.

Save the Turnips is a campaign drawing attention to child support issues and the plight of indigent child support obligors who have been locked up in debtor prisons for no crime other than being too poor to pay child support.  On June 20th the United States Supreme Court rendered its decision in Turner v. Rogers.  The case surrounded the issue of whether indigent child support payers should be provided legal counsel prior to incarceration.  Florida attorney Sam Assini joined Marti Ryan, Save the Turnips program director, to discuss this decision during July's 'Save the Turnips' blog talk radio broadcast.   Go to the 37:15 minute mark to hear the interview.  The analysis is revealing.

Also, check out Marti's interview with comedian Carl Labove at one of his recent shows in Tennessee.  Carl owes over $200,000 in back support for a child DNA has demonstrated is not his.  You'll identify with the comments of a number of people on the video.

Fathers and Families has helped introduce two new paternity fraud bills (SB 375 and SB 377) into the California legislature, both sponsored by Senator Roderick Wright (D-Inglewood).

There are many reasons to support these bills, including fairness for the men targeted by paternity fraud. But there are also compelling medical reasons to combat paternity fraud. In our official support letter for SB 375 and SB 377, Ned Holstein, M.D., M.S., F & F's Founder and Chairman of the Board, wrote:

Current California law declares that there is a compelling state interest in determining paternity for all children. SB 375 would instead declare that there is a "compelling state interest in determining biological paternity for all children." Current California law allows minors to sign paternity judgments without parental consent or legal counsel. SB 377 would prohibit this practice, which currently leads to many errors in assigning paternity.

Speaking as a physician and a Harvard-educated public health specialist, I'm writing to you because I believe SB 375 and SB 377 are important steps towards recognizing and promoting the medical importance of correctly identifying a child's paternity…

Medical schools and medical journals continuously urge physicians, particularly pediatricians, to investigate their patients' family histories. The U.S. Surgeon General has launched a major national initiative (https://familyhistory.hhs.gov) to encourage all American families to learn more about their family health histories.

According to the U.S. Department of Health & Human Services, "Knowing your family history can help your doctor predict your risk of developing diseases like heart disease, stroke, diabetes, and cancer." This is not possible when the wrong man is identified as the father of a child.

Fathers and Families has many supporters within the medical community. Fifty of our physician supporters have agreed to be listed as endorsers of the following statement:

As physicians, we agree with the U.S. Surgeon General and the National Institutes of Health that good patient care includes accurate family histories. For this reason, we endorse the principle of employing reasonable means, including DNA testing, to accurately determine children's paternity.

I am hoping you can pass the study information below on to your members in case they are interested in participating, or allow me to pass it along on the listserv. This research will help us to better understand the needs of fathers and stepfathers, who are a very under-studied group. Most people enjoy participating and find the project interesting. Thanks so much for your help!

 

I am a graduate student at the University of Michigan in clinical psychology. I am writing you today in hopes that you might be able to help me with a research study that I am currently running. Matriarchy Rules?

Have we created a Matriarchy that is bankrupting nations, abusing children?

The new feminism (second wave [the radicals]) who have to be a part of everything male while acting in a misandric fashion are creating a sadistic Matriarchy across the globe. If Men and women split everything 50/50 and women get 50% of the man's 50 and 7/8ths of the remaining twenty five percent as special entitlements that equals 97.25% - maybe that is why females make the majority of retail purchases.

I can envision men reading this crossing their legs, wringing their hands uncomfortably almost whining: I hope they read the rest of this, check out the links, STOP, breathe and then reflect: the truth is in the studies. We have for decades lazily subscribed to urban myth even though lies have been proven and dispelled: Warshak

Apparently the Jewish community is concerned with a dwindling male membership The end of Jewish Men are not the Protestant and Catholic Communities facing the same situation?

Not all single mothers are sadistic but images of Britney, Lindsey and Casey should wake us up a little simply look up female violence on You Tube . "`Oh say it is not true" exclaim the gentlemen twisting in their seats, perhaps, but this material is not made up Bringing Attention to Abuse By Females it is true Google has tried to censor such material as hate speech preferring homosexual friendly comments (sorry their editorial preference and a true statement simply ask bloggers).

All mothers probably are not that violent despite the ones we have seen grabbing their children by the arm in the grocery store, we do know (even if we are afraid to discuss it) at least some moms utilize the electronic babysitter, we have been talking about it for decades, but could it lead to this: Should parents of obese kids lose custody?

The Public Broadcast System actually airs programming that touches upon religion, last weekend I listened to a Catholic Bishop lamenting the injury upon all of those poor families that the current budget debacle will cause. I am certain the Bishop truly had in mind social injustice to less fortunate people _ I truly believe the Bishop had no conception at all he really is lamenting a minor loss in funding for the enabling of single mother homes whilst depriving children of their fathers.

There is no logic in promoting Fatherhood whilst denigrating Fathers. There is no logic in promoting a social system that separates children from their fathers whilst costing America three hundred thirty-six billion dollars annually  Sex, money…and national bankruptcies.

Perhaps no one really cares enough to have read this far, or someone is yawning, or instead of twisting in their seat someone has urinated, can we seriously imagine grown adults so afraid of women, there are afraid to read this?

Mothers are sacred, mothers are scary, what am I thinking, well I am not the happiest camper in the entire world but I am not alone; Mother's Day 2011: not so Purdy – Americas's PBS documentary,  Mother, mother, where are you?,  Another Broken Heart truth to tell this is but a minor glimpse of the anecdotal evidence.

As the men continue to cringe I can imagine someone uttering a derogatory remark. Do we even know how to educate males STOP, please do not be so sure about yourself, have you read anything found here:  Michael Gurian , any of these Books for Fathers .

Do we really know what we are advocating for: In the matter of: pornography v, romantic fantasies , Parental Alienation In our good do we do bad

 

Long letter, nothing is simple, our children deserve their Fathers, our Boys deserve to be treated for who they are, our Congregations, Synagogues and Parishes deserve participation from both sexes.

Legislation in the Ohio House of Representatives (House Bill 252) requires written consent from the father of an unborn child in order to perform an abortion.  The bill will put to test the “it’s my body, it’s my right” notion of pro-choice activists by adding the rights of the father of the unborn child into the equation.  Ideally, the decision of abortion should be a consensus between both parents, with both parties being involved in any decisions regarding the child.
This is a significant legal and social issue where parental rights are heavily unbalanced due to the fact that a father plays no role in a matter as critical as his unborn child’s life.  If a woman decides to keep her child, the father is required to pay child support regardless of whether he wanted to keep the child or not, or face future jail time.  A father currently has no say.  Alternatively he cannot opt-out of parenthood, but a woman can: She can do so by abortion.
Under the Ohio Bill, a woman must have written consent from the father; if a woman is claiming rape, she must file a police report, provide other court documents or an official complaint of the incident.  If the woman chooses to undergo an abortion in this case, the physician must have “reasonable cause” to believe the woman’s claim of rape and thus, perform an abortion.  In cases where the father may be unknown, a list of all potential fathers must be submitted to a physician.  They will all be contacted and summoned to a paternity test.  If the father is not found, no abortion can be performed.  The bill would turn abortion without a father’s permission or naming a “false biological father” into a first-degree misdemeanor with a maximum $1,000 fine.  A second occasion of providing false information would be considered a fifth degree felony.
“When the fetus is viable, no person shall perform or induce an abortion on a pregnant woman without the written informed consent of the father of the fetus,” the bill text reads.
State Representative John Adams says that the bill was not written to cause controversy.  He says that it is important that both parties who created the unborn child have a say in whether or not the pregnancy is terminated.  “Since the father will have the responsibility of child support, he should have rights regarding the birth or destruction of the fetus,” according to veteran matrimonial attorney Anthony D’Agostino (http://dadsrights.com).
Recently, an instance regarding an alleged lack of father notification in regards to an abortion has commanded national attention.  In New Mexico, a man lashed out at his ex-girlfriend by means of an anti-abortion billboard after the ex-girlfriend had allegedly undergone an abortion procedure without any notification to the purported father.  The billboard depicts a 35-year-old Greg Fultz holding the outline of an infant with text that reads, “This Would Have Been a Picture of My 2-Month Old Baby If the Mother Had Decided Not To Kill Our Child!”  The case seems more about the ex-girlfriend’s privacy than about father’s rights.
Regarding the paternal veto or override of an abortion, that is a decision which should be eventually decided in Ohio.  This important decision can set legislative precedent for every other state in our nation.

Most of us know how to inspire the old school campaign, most of us know where all of the hatchets are buried, most of us are  most probably tired of the slow pace: Let's get 'er done!

I know it takes time to post or write.
I face this whole situation everyday with my youngest, I am living it still.
 
Copy and paste, who cares, we have three hundred million people to reach in the US, seven billion on the globe. This is a time urgent situation, act now or lose another decade.

•             We have revisited the way the non-custodial parent is allowed only four days per month of parenting time, thereby becoming a "visitor" in the lives of their own children.

A contingent of Fathers and Families' Election 2012 Campaign activists attended New Hampshire GOP events over the weekend and asked presidential candidates Tim Pawlenty and Jon Huntsman about shared parenting.

F & F member Jeff Oligny asked Minnesota Governor Tim Pawlenty, a popular presidential candidate, about family court reform. Oligny, a member of the New Hampshire House of Representatives, told Pawlenty:

In today's family law system, most non-custodial parents only get to spend a few days a month with their children. This is devastating for a lot of children who love both of their parents and want to spend time with them. How do you plan on fixing it?

Pawlenty replied:

[O]ne of the most significant determining factors of how children are going to do in school and more broadly in life is the degree of involvement and engagement of their parents in their lives. We want to encourage that to the fullest extent possible. And so the laws…as they relate to the relative balance between custodial and non-custodial [should reflect] that we want both parents engaged and productive…in their children's lives.

Pawlenty, who finished tied for 2nd in a recent New Hampshire GOP Straw Poll, was also questioned on the subject by F & F member Lorraine Corbeil, a grandmother. Corbeil told Pawlenty, "We feel that all parents should have shared parenting. Mothers and fathers," to which Pawlenty replied "Right," and noted "a lot of states have made some progress about that." He also explained:

I know you [have to] make sure you have the best interest of the child, first. In some cases one of the parents has some other life issues that you have to put into the equation, too.

Pawlenty's response is reasonable–certainly we acknowledge that there are situations in which shared parenting is not appropriate, particularly if there's solid evidence that one of the parents is abusive or is unfit due to substance abuse problems, mental illness, etc.

F & F activists also took family court reform to another Republican presidential hopeful, former Utah Governor Jon Huntsman (pictured). At a June 10, event Oligny asked Governor Huntsman:

I think we would all agree that children value their parents probably more than anything in the world. And unfortunately, non-custodial parents in this country only get a chance to see their children a few days a month. And this is devastating for a lot of children who love and want to spend time with their family…what do you think you might be able to do about it?

Huntsman replied:

I totally agree with your assessment on the need for children to be able to bond and interact with their parents. When they're there, they do better. And when they are estranged, they do worse. There is something about a parent figure that is so critically important and indispensable in the lives of families.

I'm somewhat familiar with some cases that have played out in Utah where fathers in particular were estranged from their children. Unfortunately, caught up in the legal system, caught up in bureaucracy, we did what we could do. But I understand where you are coming from and if you have any specific solutions on how we ought to be looking at this issue, I'd love to hear them.

Pawlenty and Huntsman certainly stopped short of specifically calling for family court reform, in contrast to what Republican presidential candidates Newt Gingrich and Gary Johnson told F & F activists over the past couple weeks. However, we commend both of them for publicly recognizing the importance of two parent involvement in children lives after divorce or separation, and expressing interest in how to reform the system to promote it.

Given that most Americans believe children should have a relationship with both their mother and their father, one has to wonder why state legislators and family court judges think children need only a mother and a check following divorce ("Dad, mom in home is essential, Americans say," Nation, Friday).

The answer, basically, is that legislators and family court judges follow feminist jurisprudence, mothers' wishes, the money from divorce lawyers and the domestic violence industry rather than the best interests of the child. Research indicates that having parents divorce is stressful for children but that having the government intervene to divorce children from their fathers makes developmental outcomes even worse.

Specifically, social-science research clearly shows that the children of divorce fare best when the structure of the post-divorce family resembles most closely the structure of the intact, married family, which is divorce law based on the presumption of equal, shared parenting, and fare worst when the father-child relationship is severed or marginalized by family court awards of physical custody to the mother with visitation to the father. This scenario represents 85 percent to 90 percent of divorces. Most critically, the children of divorce want equal shared parenting following divorce.

Taxpayers have a vested interest in shared, equal custody following divorce. Research demonstrates that fathers have a far greater impact on attenuating negative adolescent and young adult developmental outcomes and high-risk sexual, drug, alcohol and criminal behaviors than do mothers. Attenuating negative outcomes not only saves taxpayer dollars but also saves children emotional pain.

I urge all Americans to take a moment to think about the children of divorce, think about contacting their elected officials and consider asking them to serve children, not special interests.

Group v Individual Rights

Another individual liberty that the collective claims to have power over is our individual right to parent our child. People, please start looking at what your politicians are saying about protecting your children from you and think about how they are willing to do this without clear and convincing evidence. After pondering this I’d like you to question yourself on why it is that you keep voting for these people who make laws that violate the right of others to their property and then violate our right to parent our children. Does it not follow, these people think that the collective has the right to “excess profits” why not the right for them to determine “the best interest of the child”?

BURNET, Texas (June 12) - It is popular and expedient in politics to
champion taxpayer rights, state's rights, patient rights, gay rights,
people-with-disabilities rights, even animal rights. Name any group, or make
one up, and undoubtedly someone will advocate for that group's "rights." The
problem is - there is no such thing as "group rights." Group rights are an
illusion conjured up by politicians and special interests to increase their
influence and power.

The simple, basic truth is that all rights belong to the individual. You are
born with your rights and no power on earth can take them away from you. You
cannot give your rights away. They end only when you die, and not a
split-second sooner. Individual rights cannot be divided or multiplied; and,
individual rights are superior to any other claimed rights.

Individual rights mean you can adopt whatever culture you want and live any
lifestyle you choose to live. We have the individual right to worship or not
worship whatever god we want without interference from anyone else, so long
as we do not interfere with the rights of other individuals to do the same.
It is the fundamental and universal concept recognized by our nation's
Founders. As a result of this recognition, the superiority of individual
rights became the foundation of the United States government.

The view that our rights are granted to us by the Constitution and the Bill
of Rights is equally incorrect and dangerous. As important and eloquently
written as these two documents are, they grant us nothing. America's
founding documents merely recognized, and seek to guarantee the recognition,
of the individual human rights shared by all of mankind. The Bill of Rights
does not declare human rights are valid from a set date forward. The Bill of
Rights is a proclamation to the world of something that has always been… the
sanctity, superiority and supremacy of individual human rights. The
Constitution is to serve as a warrantee of those rights, not a grant of
privilege that allows us to embrace and enjoy them.

Individual rights are the "self-evident truths" Thomas Jefferson wrote about
when he penned the words in the Declaration of Independence that "all men
are created equal, that they are endowed by their Creator with certain
unalienable rights, that among these are life, liberty and the pursuit of
happiness." He was not expressing any new ideas or concepts. He was telling
people something that had always been. Individuals have rights by birth that
cannot be given or taken away.

Two people, 200 people, 2 million people, even the world's populations
combined do not have more rights than one person. There are no such things
as "state's rights," there are only human rights possessed by people
individually from birth. A "state" may have more influence, more power, and
theoretically, a greater ability to protect individual rights. There is
certainly strength in numbers, as they say. Labor unions have proven that
numbers mean power in politics. But no group of individuals has more rights
than any one individual, nor do groups acquire special rights by being
organized.

Power and rights are simply not the same thing. The individual right to
freedom of association allows people to band together to protect their
individual rights. Such associations can become agencies designed to
control, limit, restrict or even abolish the individual rights of people who
don't belong to that group. However, even if they are successful, any law
that suppresses the rights of individuals can be nullified by the people.

As Jefferson wrote, "...law is often but the tyrant's will and always so
when it violates the rights of the individual." It makes no difference if
that tyrant is a single person or a group of people united under common
cause. The rights of the many are never greater, can never be greater, than
the rights of the few, or even the one. If we accept the illusion of group
rights, we also accept the legitimacy of tyranny. That is why when it comes
to human rights, no number is greater than one.
