Hello Fellow Citizens,

 

Attached to this e-mail is a research report by Conservatives for Judicial Integrity concerning William Baillargeon, who is running for Judge in Allegan County. The report contains extensive information on Baillargeon's history of pro-abortion, pro-lesbian-gay-bisexual-transgender contributions and associations, which voters should know about before voting. The report was done by a group of experienced researchers and done on a volunteer basis. Please verify enough sources documented in the references of the report to be convinced that the report is legitimate. (I have checked every one of them.) Then vote carefully and prayerfully.

 

Unfortunately Baillargeon has managed to convince Right To Life of Michigan Political action Committee (RLM-PAC) that he "meets criteria". After several calls and e-mails from our officers, RTL-PAC has not yet rescinded its approval. Which leads me to send out the report on Baillargeon, supplied by Conservatives for Judicial Integrity. I would like to say that in my 28 years of working with Right To Life of Michigan, this is only the second time I have publicly disagreed with them. Both times it has been in a judicial race in Allegan County. They have endorsed hundreds of candidates statewide this year, which means they have done questionnaires and interviews with hundreds and hundreds of candidates, yet errors like this, over the years are, to my knowledge, very rare. Right To Life of Michigan is one of the most effective lobbying organizations in the state, is one of the strongest pro-life organizations in the country, and should be credited with saving hundreds of thousands of innocent lives. I am hoping you will continue to support Right To Life of Michigan and Right To Life of North Allegan County. Three officers of our local group felt strongly that it was our moral duty to pass this information on to our friends and neighbors.

I am also attaching a listing of the Right To Life recommended candidates (except one) for your information.

F & F Passes 7 Bills in 2010, as Schwarzenegger Signs 3 More F & F Bills

This year Fathers and Families led the passage of seven different family law bills nationwide, as Governor Schwarzenegger recently signed the remaining three California F & F bills. F & F was also instrumental in helping defeat three harmful bills. The seven bills we were instrumental in passing include:

1. Alimony Reform (CA. SB 1482): Parents who face alimony increases after their child support ends will now be able to demand a vocational examination for their ex-spouses, and judges are required to calculate alimony based on the examiner’s estimate of the ex-spouse’s earning capacity.

 

2. Child Custody Protection for Military Parents (CA. AB 2416): Creates a rebuttable presumption that upon a service member’s return from deployment, child custody and visitation orders will revert to the original order. Allows judges to award a deployed parent’s parenting time to grandparents or stepparents so that deployed parents can’t have their contact with their children severed by the custodial parent. This also helps to maintain and nurture children’s bonds with their deployed parent’s family.

 

3. Child Custody/Visitation Reform (CA. SB 1188): Will help prevent family court litigants from using a parent’s disability as a way to deprive them of child custody or visitation.

 

4 & 5. Protection Against Family Court Financial Abuses (Arizona HB 2358 & Indiana HB 1165) F & F helped pass bills in both Arizona and Indiana which protected disabled veterans from family court financial abuses. Both bills were inspired by and modeled on SB 285, a bill we helped pass in California in 2009.

 

6. Child Support Reform (CA. SB 580) The high cost of medical care is a burden for everybody, but the healthcare obligations family court judges throw onto noncustodial parents can be devastating. SB 580 will ensure that noncustodial parents aren’t saddled with an unreasonably high percentage of their children’s medical care costs.

 

7. Child Support Reform (CA. SB 1355) Many young fathers who were incarcerated for nonviolent offenses face crushing child support debts which accrued (at 10% interest) while they were behind bars. These debts make it difficult for them to play a meaningful role in their children’s lives. This bill suspends child support from accruing while the obligor is institutionalized.

Legislative work isn’t just about passing good bills—it’s also about defeating harmful ones.

 

There is a nationwide reactionary backlash against recognition of Parental Alienation, and California is the battleground where it is being fought. The California National Organization for Women and the powerful, well-funded Center for Judicial Excellence in Northern California are leading the backlash, and Fathers and Families has been at the forefront of fighting it.

 

Bills F & F helped defeat this year include:

1. Parental Alienation in Family Court (CA. AB 612): This bill would have prevented target parents of Parental Alienation from even uttering the words “Parental Alienation” in family court, and custody evaluators and mediators would have been prohibited from citing alienation.

 

2. Custody Evaluators and Parental Alienation (CA. AB 2475): A complicated bill but the bottom line is that it would have led to child custody evaluators and mediators being punished for making findings of Parental Alienation.

 

3. Children and Medical Care (MA  HB 930): Fathers & Families opposed and testified against HB 930, a bill supported by the Massachusetts Women’s Bar Association that would have further marginalized noncustodial parents in relation to their children’s medical needs.

F & F of Ohio’s Don Hubin Discusses SB 292 on Cincinnati Radio; Ohio Senator Bill Seitz Responds to F & F’s Criticism

Donald Hubin, Ph.D., Chairman of Fathers and Families of Ohio’s Executive Committee, appeared on the Scott Sloan Show on WLW AM 700 in Cincinnati on Monday to discuss SB 292, a new Ohio bill that will raise child support. The next day Sloan had the bill’s co-sponsor, Senator Bill Seitz (R-Cincinnati), on his show and asked him in detail about SB 292.

 

Seitz pointed to a few positive aspects of the bill–aspects which F & F has previously publicly acknowledged–but seems to be confused about the way the bill will raise child support levels. Sloan told Seitz about some of Hubin’s criticisms of the bill, and also about the flood of callers he had Monday who told him that they were unable to get downward modifications on their child support when they were laid off or had their wages cut.

Sloan also told Seitz about the callers who had said that their exes violate their visitation rights with impunity. He cited one who said he lives five minutes away from the child for whom he had been paying child support for many years, but has not seen his child in five years. The child’s mother refuses visitation, in violation of court orders, but the court doesn’t enforce it.

 

Seitz was sympathetic, saying “There ought to be a more expeditious way” to enforce visitation.

 

During the Tuesday show many fathers, including some Fathers and Families of Ohio supporters, called in with horror stories about the abusive child support system. Interestingly, a grandmother and a second woman who is a great-grandmother both detailed the injustices of the system towards their child support obligor family members.

MICoA Rules Judge must Evaluate Custody

"In Custody Hearings, the Judge Cannot Just Rely on Friend of the Court’s
Recommendation"

"However, the Judge cannot just adopt the recommendation without hearing
testimony and considering evidence. This requirement was reiterated in the
case of Deling v Lam, unpublished case per curiam of the Michigan Court of
Appeals, issued October 7, 2010 (Docket No. 295272). In that case, the trial
judge merely adopted the Friend of the Court recommendation, which radically
changed the physical custody arrangement from joint physical custody to giving
the father sole physical custody. The trial judge did not hear testimony or
consider evidence—the judge just adopted the recommendation. The mother
appealed, and the Court of Appeals reversed the trial court’s decision, stating
that the trial judge improperly delegated its authority by failing to
independently evaluate each of the best interest factors. The Court of Appeals
reversed the trial court's decision and sent the case back to the trial court
for a new custody hearing."

Members of this group complained to the Michigan Senate, Michigan House, and
Governor 9/6 - 9/30-ish about these very same due process rights for parents
during custody hearings.

While there may be no connection between our political petition and this court
of appeals ruling, it's always possible that the light we shed on this issue
encouraged the court to make the correct call to defend the rights of parents to

in the care and custody of their children to a literal rubber stamp process.

Action Alert: Bill Seeks to Raise Child Supoprt Levels in Terrible Economy; Ohio F & F Affiliate Launched


 

Short Version: Ohio SB 292 will raise child support levels in the face of the worst economy since the Great Depression. Fathers and Families of Ohio is working to defeat SB 292 this legislative session but we need your help—please fill out our form here and we will send your letter to all appropriate legislators.

Background Information: Senator Shirley Smith (D-Cleveland) and Senator Bill Seitz (R-Cincinnati) have introduced Ohio SB 292 into the current Ohio legislative session. While the bill does have some significant positives, it has some very ugly negatives. These are all detailed here.

Fathers and Families is working to stop SB 292 in its present form. Fathers and Families is the nation's leader in passing child support and alimony reform legislation to ensure that obligors are being treated fairly. Examples of some of our legislative successes in these areas include AZ HB 2348, CA SB 1482, CA SB 580, CA SB 1355, CA SB 285, IN HB 1165, and MA HB 930.

Moreover, in Massachusetts we were responsible for reducing excessive child support by over $1 billion in Massachusetts from 2001 through 2008.

We will work constructively with Ohio legislators to create a child support bill that will be fair, protect children, and promote the active involvement of both parents in their children's lives.

Greetings from F & F of Ohio's Executive Committee: We Have a Lot of Work to Do, and We Want You to Be a Part of It

Every child has a right to the loving guidance and support of both parents. Ohio, like other states, has adopted laws, practices, and public policies that do not protect this right, and sometimes actively undermine it. Fathers and Families of Ohio has been formed to address this problem and to bring to Ohio the gains that Fathers and Families has achieved in other states.

We're committed to the following:

·      Parenting-Time Enforcement: Research shows that many non-residential parents in Ohio have difficulty exercising their court-ordered parenting time because of interference by the other parent. We are working with the Ohio Fatherhood Commission and selected legislators to provide a prompt, low-cost, effective solution to this problem.

·      Alimony Reform: We seek: a cap on the duration of any spousal support obligation to half the length of the marriage; a prohibition against continuation of spousal support past the age of retirement; to eliminate "double dipping” (the consideration of a obligor's business both as an asset in the property division and as a source of income for purposes of spousal support); and numerous other reforms to R.C. 3105.18, Ohio's spousal support statute.

·      Presumption of Shared Parenting: Children of divorce or separation should be permitted to have as full a relationship with each parent as possible. We seek to create a law under which each custody case begins with a legal presumption of shared parenting and moves to sole custody only if it is necessary to protect children.

·      Child Support: The Ohio Senate is considering a bill that would significantly increase the rates in the Basic Child Support Table. We're working with the Ohio Office of Child Support and with state legislators to ensure that child support is reasonable and fair.

·      Military Parents' Child Custody Rights: Many deployed service personnel face serious family court issues. We seek to follow up on Fathers and Families' legislative successes in other states with Ohio legislation that protect deployed servicemembers' child custody and parenting time rights and shield them from family court financial abuses.
